1. GETTING STARTED
1.1 About these Terms
Welcome to the Canadian Addiction Counsellors Certification Federation. We provide certification, professional development, training information, and member services for addiction and mental health professionals across Canada (the Platform). These Terms of Use (Terms) form a legal agreement between you and CACCF and apply to your access and use of the Platform, including www.caccf.ca and any related online features or services we provide (the Services).
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.
By using the Services, you confirm that you are a legal resident of Canada, are the age of majority in your province or territory, and are not prohibited by law from entering a binding agreement with CACCF. If you are under the age of majority, your parent or legal guardian must agree to these Terms on your behalf.
If you are accessing the Services on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
1.2 Types of Users
These Terms apply to all users of the Services. CACCF recognizes two general categories:
• Certified Professionals and Applicants. Individuals using CACCF Services for certification, training, membership, professional development, or related services.
• General Users. Individuals visiting the website for information, resources, public interest, or employer verification.
Except where stated, all provisions apply to every user.
1.3 Electronic Communications
By using the Services, you agree that CACCF may contact you electronically for membership notices, certification updates, training information, or other communications related to your use of the Services. You may withdraw consent at any time by following unsubscribe instructions or by contacting us at info@caccf.ca. This may affect your access to certain Services.
1.4 Amendment
CACCF may update these Terms at any time. Updated versions will be posted on the Website. Your continued use of the Services means you accept the updated Terms. If you do not agree with changes, you must stop using the Services.
2. PERMITTED USES
You may use the Services only for legitimate, lawful purposes related to:
• certification, membership, credential maintenance, and professional standards
• accessing or submitting continuing education information
• accessing training content and professional development materials
• verifying certification status
• obtaining information about CACCF or the profession
• communicating with CACCF for support, inquiries, or administrative needs
Any other use is prohibited unless expressly authorized by CACCF in writing.
3. REGISTRATION AND YOUR ACCOUNT
To access certain Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining confidentiality of your account and password and for all activity under your account.
You agree to update your information as needed. CACCF may suspend or terminate your access if information is incorrect or incomplete.
If you suspect unauthorized use of your account, you must notify us immediately at info@caccf.ca.
CACCF is not responsible for any loss resulting from unauthorized access due to your failure to protect your account.
4. INTELLECTUAL PROPERTY RIGHTS AND OWNERSHIP
All content, materials, trademarks, and information on the Services are owned by CACCF or its licensors and are protected by Canadian intellectual property laws.
You receive a personal, limited, non transferable, non exclusive licence to view and use the content for permitted purposes only.
You agree not to:
• copy, distribute, modify, publish, transmit, or create derivative works from CACCF content
• reverse engineer or attempt to extract source code
• use CACCF trademarks without written permission
• provide CACCF content to third parties without authorization
All intellectual property created or developed by CACCF remains the exclusive property of CACCF.
5. USE OF SERVICES
You agree to use the Services legally, responsibly, and in accordance with these Terms. You must not:
• violate any federal, provincial, or municipal law
• upload or transmit harmful, defamatory, abusive, obscene, or discriminatory content
• impersonate others or misrepresent your identity
• attempt to gain unauthorized access to the Platform or other accounts
• distribute malware or disruptive technologies
• harvest data, scrape, or use automated tools to collect information
• interfere with the functioning of the Services
• misuse certification marks or CACCF branding
CACCF may restrict or terminate your access if you violate these Terms.
6. PRIVACY POLICY
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and disclose personal information in compliance with Canadian privacy laws. By using the Services, you consent to these practices.
7. TERMINATION
CACCF may suspend or terminate your access to the Services at any time, with or without notice, including when:
• you violate these Terms
• you misuse CACCF credentials or marks
• we need to protect security or integrity of the Platform
• required by law
Upon termination, any rights that are intended to survive will remain in effect.
8. LIMITATION OF LIABILITY AND DISCLAIMERS
8.1 Limitation of Liability
To the fullest extent permitted under Canadian law, CACCF, its directors, employees, agents, and partners are not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Services.
If CACCF is found liable despite these Terms, total liability will not exceed one hundred dollars (100 CAD).
8.2 Availability and Accuracy
The Services are provided on an as is and as available basis. CACCF does not guarantee that the Services will always function without disruption, error, or loss of data.
CACCF does not guarantee the accuracy, completeness, or currency of any content.
8.3 Downloads and Security
CACCF cannot guarantee that downloadable files are free of viruses or harmful code. You are responsible for your own data security.
8.4 Third Party Sites
The Services may link to third party websites. CACCF is not responsible for content, accuracy, or practices of any external site.
8.5 No Reliance
Information on the Services is provided for general informational purposes only. It is not legal, medical, clinical, or professional advice. You are responsible for obtaining professional guidance when needed.
9. INDEMNIFICATION
You agree to indemnify and hold CACCF harmless from any claims, losses, or expenses arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third party rights.
10. MISCELLANEOUS
10.1 Force Majeure
CACCF is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, labour disputes, power failures, or system outages.
10.2 No Agency
Nothing in these Terms creates a partnership, employment relationship, or agency relationship.
10.3 Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Legal actions must be brought exclusively in the courts of Ontario. You agree to this jurisdiction and venue.
10.4 Waiver
Failure to enforce any right does not waive that right. A waiver must be in writing to be valid.
10.5 Severability
If any part of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
